standing at Mountainview Walking Horse Ranch, and to pay a breeding fee of
$350.00. The breeding fee is due before departure of the mare from
Mountainview Walking Horse Ranch, or in case of shipped semen, the balance
is due before the semen is to be shipped, unless other arrangements have
been made with Mountainview Walking Horse Ranch.
OTHER EXPENSES:
It is understood and agreed that in addition to the above stated fee, the
mare owner shall pay for the cost of stallion collection. Stallion
collections are $_______ per collection. In case of transported semen,
the Mare Owner is responsible for paying the shipping cost.
Board expenses are at a rate of $________ per day for open mares, or
$_________ per day for wet mares, plus veterinarian expenses including
drugs, medications, and supplies as required, farrier expenses and all
other expenses reasonable and necessary to insure the well-being of the
mare. Mountainview Walking Horse Ranch shall be paid in full before the
departure of the mare.
CONDITIONS FOR ACCEPTANCE:
The mare must be halter broke and able to be handled. Prior to, or at the
time of arrival of the mare, a copy of the mare's registration papers
shall be furnished to Mountainview Walking Horse Ranch. Culturing of the
mare is highly recommended. The mare should be in good health. Mares
should have current vaccinations and worming. Mountainview Walking Horse
Ranch reserves the right to refuse acceptance of the mare under this
agreement, if a major medical problem arises which would preclude the
breeding of said mare. Upon notification, this contract shall terminate
and the parties shall be relieved of any further obligations or
liability. The mare owner has an obligation to remove the mare from
Mountainview Walking Horse Ranch at mare owner's expense, at which time
all outstanding bills are to be paid. The mare owner has the option
at this time, to substitute another mare to complete this contract.
LIVE FOAL GUARANTEE:
Mountainview Walking Horse Ranch guarantees a live foal from the mating.
A live foal is defined for the purpose hereof as one which stands and
nurses. Should the mare abort at any time after her departure or should
her foal be born dead, the mare owner is guaranteed a return privilege for
the same mare or a substitute mare, during the same season or the
following calendar year free of any additional fees, except for any of the
aforementioned board fees and expenses.
CONTRACT NULLIFICATION:
It is understood that should the stallion die or become unfit for service,
and the mare does not produce a foal, this contract will be declared null
and void, in which case, all money paid as breeding fees only, shall be
refunded to the owner of the mare.
WAIVER OF LIABILITY:
Mountainview Walking Horse Ranch agrees to and shall exercise reasonable
care, attention and judgment in the board, keep, maintenance, palpating
and breeding of the mare and/or foal while on its premises, including any
and all veterinarian procedures. Mare owner hereby waives any and
all claims by reason of any such injury, escape, disability, or death
while on the premises of Mountainview Walking Horse Ranch.
GENERAL UNDERSTANDINGS:
The parties further agree as follows:
In the event of injury to or sickness of the mare and/or foal,
Mountainview Walking Horse Ranch shall immediately notify the mare owner
and, time permitting, will not perform, or permit to be performed,
anything other than the usual conventional medical or veterinary
procedures, without prior consultation with the mare owner or his/her
veterinarian:

This contract signed by the respective parties and on the dates set forth
below, constitutes the entire agreement between the parties and same may
not be amended or modified, except by a mutual exchange of written
instrument, nor may this contract or any rights or obligations hereunder
be assigned without the prior written consent of both parties.
